# Caste Status in One State Does Not Automatically Apply in Another, Rules Orissa High Court

**BHUBANESWAR** — The **Orissa High Court** has delivered a significant ruling on reservation dynamics, declaring that an individual recognized as a **Scheduled Caste (SC)** in **[Jharkhand](https://www.google.com/search?kgmid=%2Fm%2F01c0h6)** cannot automatically claim the same reserved status or benefits in **[Odisha](https://www.google.com/search?kgmid=%2Fm%2F01l69g)**. This holds true even if their community is classified under a different reserved category, such as **Scheduled Tribe (ST)**, in the neighbouring state. The order was passed on Friday by **Justice Sashikanta Mishra** while presiding over a petition filed by Binoy Krishna Das. The single-judge bench quashed a letter issued by the District Registrar-cum-Additional District Magistrate (ADM) of **Mayurbhanj**. The administrative order had previously required the petitioner to obtain mandatory regulatory permissions under the **Odisha Scheduled Areas Transfer of Immovable Property (by Scheduled Tribes) Regulation, 1956**, before resubmitting his property sale deed. The High Court clarified that because the petitioner’s caste origin was officially recognized as SC in Jharkhand, he could not be treated as either an SC or an ST within the state borders of Odisha. Consequently, the strict legal restrictions intended to regulate the transfer of tribal lands do not apply to his transaction.

This judgment reinforces established constitutional jurisprudence that reserved category benefits are tied to specific state notifications and cannot be carried over or converted during interstate migration
